SUNNYVALE, Calif. -- India’s Foreign Regional Registration Office (FRRO) in Hyderabad has been performing audits to check if companies have searched for local labour prior to hiring a foreign national. Similar practices are also observed by FRRO offices in Kochi and Bengaluru, however not on a regular schedule. These practices indicate that labor market testing may soon become a reality.
Companies operating in India and intending to hire foreign nationals should be prepared to demonstrate that they have made local recruitment efforts. Such companies are advised to maintain sufficient documentation concerning labor market testing to avoid delays and possible actions from local authorities.
Employers should be aware of this practice in Hyderabad, Kochi and Bengaluru and consider that other regions may follow suit, advises Nair & Co.’s International Human Resources Team.
