SGS Summarizes Canadian Proposal to Regulate Toxic Substances in Certain Products

December 01, 2023 - SGS, the world’s leading testing, inspection and certification company, has published SafeGuardS 157.23 to summarize Canada’s proposed regulation to prohibit coal-tar-based sealant products and restrict polycyclic aromatic hydrocarbons (PAH) in pavement and roofing sealants.

The draft regulation – Certain Products Containing Toxic Substances Regulations – was issued alongside a consultation that started on November 18, 2023. Comments will be accepted until January 28, 2024, and, if approved, it will enter into force on the day it is registered.

The draft regulation seeks to ban coal tars and their distillates in pavement sealants, roofing sealants and sealants for a variety of industrial uses. The provisions relating to PAH would require a restriction to no more than 1,000 ppm (total).

SGS publishes SafeGuardS to keep stakeholders informed about regulatory and market changes that may impact their business. SafeGuardS 157.23 includes information on both coal tars and their distillates and PAH, as well as a table containing a summary of the regulation and its proposed effective dates. There are also details of derogations, etc. and an overview of an additional set of restrictions within the draft regulation relating to 2-butoxyethanol (2-BE).
