Remedation Products, Inc. Petitioner Vs. Innovative Environmental Technologies, Inc. Patent Owner

PIPERSVILLE, Pa. - Oct. 7, 2020 - In August 2019, pursuant to 35 U.S.C. § 311 et seq. and 37 C.F.R. § 42.1 et seq., Petitioner, Remediation Products, Inc. ("Petitioner") petitioned for an inter partes review of U.S. Patent No. 7,531,709 ("the '709 Patent"). Claim 1 recites a method for accelerated anaerobic dechlorination including two steps of supplying ingredients (a "mixture including a zero valent metal" and an "organic hydrogen donor") to the same "permeable" subsoil locations.

The RPI petition was not the first IPR filed with the USPTO regarding the 709' patent. In fact in the past several years IET has either settled or sucessfully defended the 709' patent when inter partes and ex partes reviews were filed with the USPTO. The current RPI inter partes petition has regurgitated many of the same claims IET has successfully addressed in the historical petitions.

Since August IET has deposed the RPI expert twice and RPI has deposed IET's expert once. The progression of the petition has followed and continues to advance under the following schedule:

USPTO will rule on the IPR petition no later than February 2021.
