Mitchiner Law implements asset protection to shield their clients from creditor claims, which are claims that can be filed against a person, even after they've passed.

Mitchiner also works with clients to set up Wills and Trusts. Wills are documents that detail who will receive property and assets of the deceased. Wills also allow for the client to appoint a legal representative to their assets in the event of their death- an additional layer of security and confidence that assets will properly be managed.

Trusts vary from Wills in a few important ways. Wills take affect after the owner has passed, but a Trust can take effect immediately. When clients set up a Trust, they will assign a "trustee", or a responsible party that will hold power over the "beneficiary" of that trust. Trusts can be structured in many different ways, but usually are set up with two beneficiaries. One that will receive money from the trust while the owner of the Trust is still living, and one which will receive the remainder of money from the Trust after the owner has passed.

Probate is a process in Estate Planning that ensures the appointed legal representative is given power to make decisions on behalf of the estate and will distribute the property of the estate to the proper beneficiaries.
