Four New SVHCs Added to EU’s Candidate List Under REACH

February 11, 2020 - Operators in European Union (EU) should be aware the European Chemical Agency (ECHA) has added four new Substances of Very High Concern (SVHC) to its Candidate List under REACH.

The ECHA added the four substances to the Candidate List on January 16, 2020. They are:
1. 2-Benzyl-2-dimethylamino-4'-morpholinobutyrophenone
2. 2-methyl-1-(4-methylthiophenyl)-2-morpholino- propan-1-one
3. Diisohexyl phthalate
4. Perfluorobutane sulfonic acid (PFBS) and its salts

Substances 1 and 2 are both members of the alkylaminoacetophenone (AAAPs) family of chemicals. They have been classified as toxic for reproduction category 1B (Repr. 1B). Potential uses include:
• Photo initiator in polymer production
• Manufacture of inks and surface coatings based on acrylates polymerised by exposure to UV radiation
• High-speed offset and flexo inks, UV inkjet, etch resists, printing plates and solder masks

Substance 3 - diisohexyl phthalate - is a component of a substance already on the Candidate List: 1,2- benzenedicarboxylic acid, dihexyl ester, branched and linear. It is also classified as Repr. 1B and its uses include:
• Sealant
• Plasticizer in plastics

Finally, substance 4 – perfluorobutane sulfonic acid (PFBS) and its salts – are members of the per- and polyfluoroalkyl substances (PFASs) group. They have been classified as having an Equivalent Level of Concern (EQC). Uses include:
• Additive in polycarbonates
• Electrical and electronic equipment and metal plating

Article 33 of REACH contains obligations for manufacturers and importers of consumer goods, and other articles, into the EU and European Economic Area (EEA), if the concentration of the SVHC listed in the Candidate List exceeds 0.1% (w/w). If this happens, they must provide information for the safe use of the article by the recipient upon supply. The same information must also be supplied to consumers within 45 days of a request.

An additional obligation, under Article 7, is that articles containing a concentration above 0.1%, and in a quantity exceeding one tonne per year, must notify the ECHA. This should be made within six months of the SVHC being added to the Candidate List.

Stakeholders have until July 16, 2020 to notify the ECHA, if required, in relation to the four new SVHCs. This amendment brings the total number of SVHCs on the Candidate List to 205.
