SGS Publishes SafeGuardS on Latest Additions to EU SVHC Candidate List

February 02, 2023 - SGS, the world’s leading testing, inspection and certification company, is reminding stakeholders that the European Chemicals Agency (ECHA) has added nine substances to the Candidate List of substances of very high concern (SVHC).

The nine substances are:
1. 1,1'-[ethane-1,2-diylbisoxy]bis[2,4,6-tribromobenzene] (BTBPE)
2. 2,2',6,6'-tetrabromo-4,4'-isopropylidenediphenol (tetrabromobisphenol A (TBBPA))
3. 4,4'-sulphonyldiphenol (bisphenol S (BPS))
4. Barium diboron tetraoxide
5. Bis(2-ethylhexyl) tetrabromophthalate covering any of the individual isomers and/or combinations thereof (TBPH)
6. Isobutyl 4-hydroxybenzoate (Isobutylparaben (IBP))
7. Melamine (1,3,5-triazine-2,4,6-triamine)
8. Perfluoroheptanoic acid and its salts (PFHpA and its salts) (sodium perfluoroheptanoate/ potassium perfluoroheptanoate/ ammonium perfluoroheptanoate/ perfluoroheptanoic acid)
9. Reaction mass of 2,2,3,3,5,5,6,6-octafluoro-4-(1,1,1,2,3,3,3-heptafluoropropan-2-yl)morpholine and 2,2,3,3,5,5,6,6-octafluoro-4-(heptafluoropropyl)morpholine

The Candidate List now contains 233 substances. Once a substance is listed, companies (manufacturers and suppliers) must comply with certain legal obligations relating to the substance, either on its own or in mixtures or articles.

If an article contains a Candidate List SVHC in a concentration higher than 0.1%, the company must provide information to the recipient to allow safe use. Upon request, they are also required to provide the same information to consumers within 45 days. They must also notify the ECHA within 6 months of a substance being included on the Candidate List is a product contains a listed substance and suppliers must provide their customers with a safety data sheet (SDS).

Finally, since January 2021, EU producers, importers, assemblers and distributors of articles containing more than 0.1% of an SVHC on the Candidate List are required to notify the ECHA (Waste Framework Directive, WFD). Notifications are published on the substances of concern in products (SCIP) database.

SGS has published SafeGuardS 009.23 to help manufacturers and suppliers operating in Europe gain a better understanding of this expansion in the Candidate List. In addition to information on the obligations listing places on companies, it also contains a table that details the nine chemical substances, their reasons for classification and potential applications.
