Viral Load Spreads From Rose Garden to SCOTUS Hearings

WASHINGTON - Oct. 3, 2020 -A week after a campaign-style ceremony at the Rose Garden for Republicans to gloat over ram-rodding Supreme Court pick Amy Coney Barrett through the Senate, replete with mask-less glad-handing and hugs, it has become increasingly obvious that, with numerous attendees having contracted COVID-19, the event is the most likely source of the spread of the virus throughout the White House staff, Republican Senators, the President, and those coming into contact with a "super spreader" at the event.

But it is the infection of politics itself into the SCOTUS nomination process to such a degree as that reflected in the decision to force-feed Barrett into the diet of the electorate that is of equal concern to some observers.

The irony of the circumstances surrounding the investiture of Barrett to the high court is not lost upon James Starke, author of a novelization of the Supreme Court (A Matter of Principle) who notes that Barrett herself has tried to explain the difference between a more restrictive, "conservative" judicial philosophy concerning constitutional rights, such as that espoused by her former boss, Antonin Scalia, and a more expansive, "liberal" interpretation of such rights by justices such as Scalia's good friend and polar opposite, Ruth Bader Ginsburg.

"The politicization of the process infects the court, in an unwholesome manner, with a misconception, at least in the minds of the public, if not some of the justices that judges are free to decide questions based on their preferred political outcomes rather than the law. Barrett's fate should be decided not on her likely vote in a contested election or on the validity of the ACA but on issues such as her more restrictive interpretation of civil liberties."

Starke's book is due to be released Monday, October 5th at the start of the Supreme Court's term. Barrett is expected to be confirmed either before November's election or shortly thereafter.
